Is BJUnity A True Not-For-Profit Incorporation?

BJUnity is a website with Jeffrey Hoffman as its “Executive Director” whose claimed goal is “an affirming alternative for lgbt alumni and students of Bob Jones University”. [“lgbt” stands for “lesbian, gay, bisexual, transgender”]. Jeffrey Hoffman is also a regular contributor to Do Right BJU and submits comments on numerous anti-fundamentalist websites.

On March 11, 2013, Jeffrey made slanderous accusations that Elisha Weismann, Dr James Ach and Jerry Kaifetz were the same person in response to an article written that demonstrated he was supportive of the Islamic religion. After contacting Facebook about the accusations and the photos he posted on his page, Facebook removed the references on his page.

When someone goes out of their way to slander us (and by “us” we mean anyone associated with DRC. Jerry Kaifetz is not associated with any of the Do Right Christian ministries or websites) on a personal level when they can’t hold a debate about religious issues that are the topic of a discussion, sometimes we do a little of our own checking, and we have some questions about BJUnity. We are not insinuating anything here, but just seeking some answers that perhaps we overlooked in our investigation of BJUnity.

BJUnity claims to be a “Not-For-Profit Incorporation” (“EXH A” below) and has a Donation Tab at the bottom of their website.

Just for review, here are the New York State laws for not-for-profit incorporations.

Upon a search, we could not find a Federal Tax ID# (“EXH B”).

We could not locate a profile on Guidestar (“EXH D”). Guidestar is a company where a corporations IRS 990 forms can be viewed. If you are not familiar with them, we have posted a picture below (“EXH C”) of G.R.A.C.E. (Godly Response to Abuse in the Christian Environment) to show what a non-profit organization’s Guidestar profile looks like.


If Jeffrey or someone that works for BJUnity can fill in the gaps here, we’ll wait for a response before we make a conclusion based on our research.






BJUnity gave the following response:

BJUnity is a not-for-profit charitable organization, incorporated in the State of New York in June 2012.

Our application for federal 501 (c) (3) status is in process.

A Few things to address about this:

1) *REMOVED Upon Verification Certificate.

DOS ID #: 4258642

2) If they admit that their application for 501 (c)(3) status is “in process” then it is not yet a true not-for-profit organization that should be collecting donations under that guise.

3) Has BJUnity told their donators that their charitable gift is not tax deductible until their 501 (c)(3) status is approved?

4) BJUnity appears to be founded in the middle of 2012, yet there is nothing on your website that advises potential donors that your 501 (c)(3) status is pending, or when you applied for it which would be important considering that it normally does not take 9 months for approval.

    I don’t know if there is any connection or not, but listed among the BJUnity “Founding Board Members” is a “Richard Merritt, Esq.”

    Rich Merritt did attend law school in CA and was admitted to the bar there (2001). Merritt also worked for a time in GA and was admitted there (2005), but has since become inactive. Currently Merritt resides in NYC but is not licensed to practice law in the state of NY.

      He could technically still be practicing law in California. Most courts have (and in some states, and in federal court, it’s mandated) electronic filing, so could still perform preliminary paper work and fly to CA for necessary court appearances which still would not be a bad supplemental income even if he has given up his practice for a more lucrative job (and we both know what that job is).
      He could have assisted with any applications or charter but would have had to do so “under the table”.And of course, somebody still had to pay the fee for the application (and they aren’t cheap). But by BJUnity’s own admission on their FB page in response to us, they have not yet obtained 501(c)(3) status, and have not advised their potential donators of their pending status which is required if they are currently accepting donations (which I would have to assume they are since there has been a donation tab there for nine months).

    Mr. Ach… you really don’t know much about the whole non-profit world. BJUnity is able to collect donations legally.

    You need to get facts correct before spreading libel.

      Most of the staff that work here work in the legal field and know exactly what the requirements are. We also work with churches on a regular basis.
      Furthermore, the article NEVER SAYS IT IS A FRAUD OR NOT LEGITIMATE. Learn how to read. It says there are elements typical of a non profit organization that are missing which are stated in the article. Now if you connected the dots in a different way, you made that leap, not us.

      In your little post, Jeffrey says that the incorporation can be verified with the State of New York. I have the screenshot above from the State of New York’s official government website that does not show the results. As often as Jeffrey screenshots or posts information as quickly as he gets it, why not simply screenshot the certificate of corporation, the filing date with the governor or secretary’s signature on it?

      Furthermore, BY LAW, you are supposed to clearly state that your organization has it’s 501 (c) (3) status pending because donors can not write off tax deductions until that status is approved. This fact is told plainly to applicants when they apply and for the nine months that BJUnity has been founded, that declaration has never been posted on their site.

      And if you know so much about the law, why are you using an outdated legal term? (“Libel”). Perhaps you should get a current Black’s Law Dictionary and look up the current cause of action terminology that has replaced “libel” and “slander”.

      And doesn’t it get old accusing fundamentalists of “hate speech” simply because we say the Bible is against homosexuality? Your crowd, Jeffrey in particular, make fun of Baptists, call us names, lie about us, make false accusations and then act like a victim when we respond back.

      The hypocrisy and blatant lie Jeffrey states on this page about fundamentalist couldn’t be missed by Ray Charles. “We are determined to remain the voice for change within the fundamentalist Christian community and, as far as is humanly possible, to respond with dignity and kindness.” Give me a break. What makes a homosexual think he’s ever going to convince a fundamentalist that homosexuality isn’t a sin? Be honest, the agenda is to shut Christians up which is really what “change within fundamentalism” means.

      Jeffrey has done nothing but lie about staff here, and attempt to get everyone’s Facebook pages shut down and reported every comment they’ve ever said and then acts like his own turds don’t stink like he’s some pious loving Christian. And it was Jeffrey that came to OUR PAGES FIRST accusing us of “hate” when all we did was merely posted an article in disagreement with his views. Jeffrey said we were all demon possessed, that we were blaspheming the Holy Spirit, and that we were all going to hell because of our “lies and slander”. Now how’s THAT for a “Christian” who claims to respond “with dignity and kindness”.

      Get off your soap box fella because there are people here that actually know how to THINK, and who actually know and believe what the Bible says.

    Marisa actually found the certificate (golf clap). So we have amended our inquiry. See, we’re not all that bad! 🙂 If the information is verified, we correct it, unlike Jeffrey who even with evidence from a youtube video that I am not Jerry Kaifetz still keeps telling the same lie.
